Affiliate Terms and Conditions

These Affiliate Terms and Conditions ("Affiliate Terms") govern participation in the Mindbanger affiliate program.

1. Operator

2. Eligibility

  1. Every registered Mindbanger user may receive access to affiliate functionality.
  2. Only individuals aged 18 or older may receive cash payouts or otherwise participate in monetized affiliate payouts.
  3. We may require identity verification, tax information, payout information, and other compliance data before approving or executing payouts.
  4. We may deny, suspend, restrict, or terminate affiliate participation in cases of suspected fraud, legal risk, sanctions risk, AML/KYC concerns, payment risk, abuse, policy breaches, or reputational risk.

3. Affiliate Models

Mindbanger may make available two affiliate link models:

Model 1 – Second-Month Reward Model

For eligible referred users who purchase a monthly subscription through the relevant affiliate link:

  • the affiliate may receive a one-time commission equal to 100% of the referred user’s second monthly subscription payment; and
  • the affiliate may receive 20% lifetime commission on eligible one-time products purchased by that referred user.

Model 2 – Lifetime Recurring Subscription Model

For eligible referred users who purchase a monthly subscription through the relevant affiliate link:

  • the affiliate may receive 20% recurring lifetime commission from each paid monthly subscription payment, starting from the first paid subscription payment of the referred user; and
  • the affiliate may receive 20% commission on eligible one-time products purchased by that referred user.

4. Attribution and Cookie Window

  1. The standard attribution cookie window is 30 days, unless Mindbanger changes this in the future.
  2. Commission attribution depends on successful tracking, valid referral qualification, payment completion, anti-fraud validation, and the model associated with the affiliate link used.
  3. If tracking fails because of browser restrictions, ad blockers, deleted cookies, device changes, privacy settings, technical errors outside our control, or similar causes, we do not guarantee attribution.
  4. We reserve the right to determine final attribution in good faith based on our records.

5. Qualified Referrals

A referral qualifies only if all of the following conditions are met:

  1. the referred user is a genuine new or otherwise eligible customer according to Mindbanger’s records;
  2. the referral is not fraudulent, duplicated, self-referred, artificially generated, or in breach of these Affiliate Terms;
  3. the referred purchase is completed, successfully paid, and not refunded, charged back, reversed, disputed, or cancelled;
  4. the referral complies with all applicable laws, advertising rules, anti-spam rules, and platform rules.

6. Self-Use Credit Application

  1. If an affiliate has an active personal subscription and the affiliate wallet balance is equal to or greater than the applicable subscription amount, Mindbanger may automatically apply eligible affiliate credit as a discount or internal credit toward the affiliate’s own subscription.
  2. Mindbanger may also allow affiliate credit to be used toward eligible one-time products.
  3. Internal wallet or discount use may be allowed without requiring tax payout information, because no external monetary payout is being made.
  4. Wallet credit has no cash value unless and until Mindbanger approves a cash payout request in accordance with these Affiliate Terms.

7. Payouts

  1. The minimum cash payout amount is EUR 50.
  2. Cash payouts are processed only upon request, and no more than once per week per affiliate unless Mindbanger decides otherwise.
  3. Cash payouts are made by bank transfer or another payout method approved by Mindbanger.
  4. Before any cash payout, the affiliate must provide complete and accurate tax, identification, payout, and compliance information requested by Mindbanger.
  5. Mindbanger may withhold, delay, reverse, offset, or deny payouts in cases including suspected fraud, refund risk, chargebacks, sanctions risk, AML/KYC review, incomplete information, legal restrictions, accounting discrepancies, or violation of these Affiliate Terms.
  6. Affiliates are solely responsible for declaring and paying any taxes, duties, or reporting obligations arising from affiliate income in their jurisdiction.

8. Global Participation and Country Restrictions

  1. Mindbanger intends to allow global affiliate participation.
  2. However, Mindbanger may exclude, restrict, or suspend specific countries, territories, persons, traffic sources, industries, or payout methods where required or deemed necessary for legal, sanctions, AML/KYC, payment, tax, banking, compliance, or risk-management reasons.
  3. Availability of the program or payout in a country is not guaranteed.

9. Prohibited Conduct

Affiliates must not:

  1. refer themselves, create fake accounts, create duplicate accounts, or arrange artificial transactions to generate commissions;
  2. use bots, scripts, cookie stuffing, forced clicks, hidden redirects, or other deceptive attribution techniques;
  3. engage in spam, unlawful unsolicited email, unlawful messaging, or other unlawful direct marketing;
  4. make false, misleading, deceptive, exaggerated, medical, therapeutic, guaranteed-income, or otherwise non-compliant claims about Mindbanger, its products, or affiliate earnings;
  5. impersonate Mindbanger, pretend to be an official representative, or create confusion as to sponsorship, endorsement, or affiliation;
  6. register domains, social handles, ad creatives, pages, or accounts that imitate or infringe the Mindbanger brand or mislead users into believing they are official;
  7. bid on Mindbanger branded keywords, domains, or close variants in PPC advertising without prior written consent from Mindbanger;
  8. use unauthorized coupons, fake discounts, fake scarcity, false urgency, or false claims regarding product pricing or promotions;
  9. promote Mindbanger through websites, pages, content, or traffic sources involving unlawful, hateful, violent, fraudulent, infringing, pornographic, malicious, or otherwise harmful content;
  10. violate any applicable law, platform rule, data protection rule, or advertising rule.

10. Permitted Promotion Subject to Rules

  1. Affiliates may use content marketing, social media, PPC, email marketing, landing pages, reviews, educational content, and other lawful methods.
  2. Any email marketing must be lawful in the relevant jurisdiction and sent only where the affiliate has any required consent or other valid legal basis.
  3. PPC promotion is permitted only if it does not violate the prohibited conduct section, especially brand bidding, impersonation, or misleading use of Mindbanger branding.
  4. Affiliates are responsible for ensuring their content and disclosures comply with advertising, consumer, and privacy laws in all applicable jurisdictions.

11. Disclosures

Affiliates must clearly and lawfully disclose affiliate relationships where required by law or platform rules.

12. Commission Adjustments and Reversals

Mindbanger may reverse, cancel, or adjust commissions where a transaction is refunded, charged back, cancelled, found invalid, attributed in error, associated with abuse, or otherwise fails to remain a qualified referral.

13. No Employment or Agency

Participation in the affiliate program does not create any employment, partnership, franchise, agency, joint venture, fiduciary, or representative relationship between the affiliate and Mindbanger.

14. Intellectual Property and Brand Use

  1. Mindbanger may make certain branding assets available to affiliates.
  2. Affiliates receive only a limited, revocable, non-exclusive, non-transferable permission to use approved materials solely for lawful promotion of Mindbanger under these Affiliate Terms.
  3. Mindbanger may revoke, modify, or restrict brand usage at any time.

15. Monitoring and Enforcement

Mindbanger may monitor affiliate traffic, conversion behavior, promotional practices, compliance indicators, and public-facing promotions. We may request explanations, documents, or corrective action at any time.

16. Suspension and Termination

Mindbanger may suspend or terminate any affiliate account or payout access immediately, with or without notice, where we reasonably believe there is a breach of these Affiliate Terms, fraud, compliance risk, sanctions risk, payment risk, reputational risk, or any other material risk to Mindbanger.

17. Program Changes

Mindbanger may amend, suspend, replace, or discontinue the affiliate program, any commission structure, any payout rule, any tracking method, or any eligibility condition at any time. Unless mandatory law requires otherwise, changes apply prospectively from the effective date communicated by Mindbanger.

18. Limitation of Liability

To the maximum extent permitted by law, Mindbanger shall not be liable for indirect, incidental, consequential, special, or punitive losses related to the affiliate program, tracking issues, lost commissions, payout delays, technical issues, or program changes.

19. Governing Law

These Affiliate Terms are governed by the laws of the Slovak Republic, excluding conflict-of-laws rules. For non-consumer disputes, the courts of the Slovak Republic shall have jurisdiction unless mandatory law requires otherwise.
